By-Laws

of

The Perth Lodge,

No.33, W.A.C.

 

CONFORMITY TO THE LAWS OF THE GRAND LODGE.

 

1. The Members of this lodge fully acknowledge the supremacy of the Grand Lodge of Western Australia of Antient ,Free and Accepted Masons, and  submit to all laws and regulations issued under its authority

 

MEETINGS.

 

2. The meetings of the lodge shall be held at the Freemason  Hall, Carrington Street, Inglewood, in the State of Western Australia, on the Fourth Friday in each month, excepting December and January, at such hour as the W.M. may appoint, the same to be mentioned in the summons calling the Lodge. Every subscribing member resident in the State shall be duly notified by the secretary of each meeting of the Lodge, such notice to state the business and to be sent seven days before the date of the meeting . No brother shall be admitted to the Lodge unless he has first signed his name in the attendance book kept for that purpose.

 

EMERGENCY.

 

3. Lodges of Emergency may be held at the pleasure of the W.M., but should an emergency meeting be called at the request of any candidate, brother or brethren for his or their special benefit, he or they shall pay the expenses incurred in holding such meeting, and no business shall be transacted thereat except that stated in the summons.

 

BUSINESS IN THE LODGE.

 

4. The usual routine of business at the monthly meetings of the Lodge shall be as follows:

A. Reading and confirming minutes.

B. Balloting for joining members and candidates.

C. Conferring degrees.

D. Reading and considering communications.

E. Passing accounts.

F. Consideration of propositions of which notice has been given at the preceding regular meeting.

G. Notices of motion

H. Proposing candidates or joining members.

 

Provided that this routine may be altered at the discretion of the W.M.

 

All questions shall be determined by a show of hands, unless any member present shall demand a ballot.

 

INITIATION OR JOINING.

 

5. Every candidate for initiation or brother for joining shall be personally known to the proposer or seconder for a period of at least six months and shall have been resident in the state for not less than six months.

 

In the case of a candidate who has not resided in this State for a period of two years the Grand Secretary shall be requested to notify the Grand Secretary of the state in which the Candidate last resided, who will be requested to furnish a report regarding the candidateà character while residing in that State and until such report is received and communicated to the Lodge the nomination shall not be proceeded with. Any member proposing a candidate for initiation or brother for joining, shall deliver to the Secretary in writing, the candidates or brother name in full, age residence, profession or calling at the time, with name and number of his former Lodge, and any other Lodge of which he is or was a member, to be inserted in the summons calling the Lodge and such candidate for initiation or joining brother shall be balloted for at the regular meeting of the Lodge immediately succeeding such nomination. Provided always that the conditions laid down in rules 8.31 and 8.35 Book of Constitutions, be observed.

 

COMMITTEE OF INQUIRY.

 

6. The W.M., Wardens, and Past Masters of the lodge shall form a committee, for the purpose of ascertaining that every candidate nominated for initiation, or brother for joining, is a fit and proper person to be admitted to this Lodge.

 

THE BALLOT.

 

7. One negative shall in every case exclude a candidate from initiation or brother from joining. Where more than one candidate is balloted for, the ballot shall not be declared until after all ballots have been taken. No ballot shall be taken for a joining member until his G.L. certificate and clearance, or certificate of his financial standing, have been produced.

 

Any brother or candidate rejected shall not be again proposed for six months.

 

LIABILITY OF MEMBERS.

 

8. The proposer of a candidate for initiation shall, at the time of proposition, deposit with the Treasurer an amount listed in appendix A as a proposition fee, which shall form part of the initiation fee. Should the ballot for such candidate be adverse, the deposit shall be immediately returned. If the candidate be accepted he may be initiated at any Lodge meeting during the succeeding three months, and should he fail to present himself for initiation within that period the deposit may be forfeited to the funds of the Lodge. The proposer of a joining member shall at the time of nomination deposit with the Treasurer the sum set down in the By-Laws as an affiliation fee. Should any ballot be adverse the fee shall be immediately returned.

 

FEES.

 

9. The following fees shall be payable in advance:-

 

Joining Fee (Other Constitutions)..refer to appendix A

Initiation Fee...........................refer to appendix A

Annual Subscription (Including Levy if applicable)...refer to appendix A

 

Provided that upon the decision of a committee comprising the Worshipful Master, Treasurer and Secretary, the annual subscription of a member over the age of 65 years, may be reduced.

 

MEMBERS OF OTHER LODGES TAKING DEGREES.

 

10. A brother who may have been initiated in any other Lodge, and who shall be desirous of being passed or raised, may receive such degrees on producing the written request of his parent Lodge, if still a member, and on payment of an amoumt listed in appendix A for passing, and an amount listed in appendix A for raising; but if he becomes a joining member, then upon payment of an amount listed in appendix A for each degree, in addition to the usual joining fees. Such fees may be remitted at the option of the Lodge.

 

 

HONORARY MEMBERS.

 

11. Honorary members being free from all payments and subscriptions, shall be composed of brethren on whom the Lodge may confer that distinction as a mark of respect, and in consideration of services to the Lodge, or to Freemasonry generally.

 

ANNUAL SUBSCRIPTIONS.

 

12. The annual subscription to the Lodge shall be as listed in appendix A plus a levy as listed in appendix A provided that at the discretion of a committee comprising of the Worshipful Master, Treasurer and Secretary, the levy may be waived in respect to any member. Subscriptions (and levies if applicable) shall be payable in advance on the 1st day of February in each year, any member in arrears for four months is to be reported by the Secretary to the Worshipful Master for appropriate action, and any member being in arrears for six months shall have notice of the same from the Secretary, counter-signed by the Worshipful Master, drawing attention to this By-Law, and if such arrears be not paid at or before the next regular meeting of the Lodge, then the brother may be liable to be excluded from the Lodge after due notice (vide Book of Constitutions, Clause 9.10). 

 

BENEVOLENT FUND.

 

13. Out of each annual subscription an amount as listed in appendix A shall be transferred to the Benevolent Fund, and from time to time lodged in the Commonwealth Savings Bank, Perth, in the name of the Perth Lodge Benevolent Fund, and devoted solely to charity. Provided that as from the last day of February 1940, if and when the amount standing to the credit of such fund on the first day of March in any year, exceeds the sum of $600.00 no amount shall be so transferred out of the annual subscriptions in respect of such year, unless otherwise determined by the Lodge.

 

Such fund to be operated upon the signature of two Trustees. The Trustees to be elected at a Regular Meeting by a majority of members and to remain in office during the pleasure of the Lodge.

 

All applications for relief or donation from such fund shall be submitted to a Committee of Benevolence, consisting of the Worshipful Master, the Wardens, Secretary and Treasurer, three of whom shall form a quorum.

 

Such Committee shall report to the Full Lodge at the next regular meeting, and no payment shall be made unless a majority of the brethren present at such meeting, shall decide what sum shall be authorised to be paid out of such Fund for such purpose.

 

No payment shall be made from the Fund upon any other authority, with the exception that the Worshipful Master and Wardens, of whom two shall form a quorum, shall have discretionary power vested in them to pay an amount not exceeding $4.00 for any pressing emergency, such payment to be submitted to the lodge at its next regular meeting for ratification.

 

Notwithstanding the provisions of the foregoing clauses, if at any time subsequent to 30th June 1980, the total amount standing to the credit of the Benevolent Fund, either equals or exceeds $1000.00, then any further increments by way of income, but not by way of capital, will be transferred to the general funds of the Lodge, and for this purpose, the Trustees for the time being, on the advice of the Treasurer and Secretary, will effect the necessary conveyance of such increments, to the general account of the Lodge.

 

 

 

COUNTRY MEMBERS.

 

14. Subscribing members who, for a period of not less than six months, intend to reside more than fifty kilometres from Perth, shall, upon giving notice in writing to the Secretary of such intention, be subject to a payment as listed in appendix A per annum, in lieu of the annual subscription (if approved of by the Lodge). Immediately upon his return within the limits , such member shall pay the full subscription, subject to a reduction pro rata for each meeting of the current year previously held.

 

NOTICE OF DISCONTINUANCE.

 

15. Every member shall be liable to pay his annual subscription until he shall give notice to the Secretary, in writing, of his wish to resign. No resignation shall be accepted unless all claims of the Lodge shall have been satisfied.

 

 

 

 

 

 

 

 

VISITORS.

 

16. Every brother visiting the Lodge must be introduced by a subscribing member, and must sign his name and the name of the brother by whom introduced in the attendance book kept for that purpose, or upon proof must be vouched for by Bro. J.W.

 

ELECTIONS.

 

17. The Master, Treasurer and Tyler shall be annually elected by ballot at the regular meeting in February. The Master-Elect shall be installed at the regular meeting in April after the minutes as to his election are confirmed. He shall then appoint and invest his officers.

 

DUTIES OF TREASURER.

 

18. The Treasurer shall take charge of the funds of the Lodge, shall keep an account of the receipts and expenditure and shall deposit all payments made to the Lodge in such Bank as the lodge may select, to the credit of an account to be opened in the name of the Lodge. Cheques drawn against this account shall be signed by the Treasurer and the Secretary. All accounts must be passed at the usual regular monthly meeting. The Treasurer shall submit his financial statement, made up to the last day in January, at the regular meeting in February, for the information and satisfaction of the Lodge.

 

DUTIES OF THE SECRETARY.

 

19. The duty of the Secretary shall be, under direction of the W.M., to issue to all the members the summons calling the several meetings of the Lodge, setting forth therein all notices of motion, elections, initiations, passings and raisings, candidates to be balloted for, and specifying the particulars required by rules 8.54 and 8.59, Book of Constitutions; he shall attend each meeting of the Lodge and read the minutes ; also once a year he shall read the By-Laws when so requested by the W.M.; take a correct minute of the transactions of the Lodge, and make out the returns to Grand Lodge.

 

Declaration, Attendance, and Members Register Books shall also be kept by the Secretary.

 

 

 

 

 

THE TYLER.

 

20. The Tyler shall continue in office at the pleasure of the Lodge. He shall take care of and place the furniture in proper order, attend upon the brethren, and see that the attendance book is properly signed; and for these duties he shall be allowed such sum as the Lodge shall from time to time determine.

 

FURNITURE.

 

21. The furniture, regalia, and all property belonging to the lodge shall be vested in the Master and Wardens for the time being, in trust for the Lodge, and an inventory of same shall be presented by the Treasurer to the W.M. at the meeting following his installation, who shall examine and ascertain its correctness, previous to the next meeting of the Lodge; and such furniture, regalia, and other property shall be insured in the name of the Lodge if it exceeds the value as listed in appendix A.

 

AUDITORS.

 

22. An Audit Committee shall be appointed annually at the meeting in November, such committee to consist of two members, one appointed by the W.M., and the other elected by the brethren present. They shall examine the accounts of the Lodge and pass the balance sheet, and present the same to the Lodge; also check the inventory of the jewels and furniture, and consider all things to promote the interests of the Lodge, making a report of their proceedings, in writing, if necessary.

 

MOTIONS.

 

23. Notice of motion must be given at a regular meeting of the lodge before being debated, and must be handed to the secretary, in writing, and may then be considered at the next regular meeting

 

DISCUSSIONS.

 

24. No brother shall be allowed to speak more than once on any matter or question without special permission from the Chair, except the mover, who shall be entitled to reply. Nor shall a brother speak on any matter or question for more than five minutes, except by special permission from the Chair.

 

 

LIST OF MEMBERS.

 

25. A correct list of members of the Lodge shall be annually printed and circulated in April, and sent to each member of the Lodge on or before the night of Installation.

 

NUMBER OF SUBSCRIBING MEMBERS.

 

26. Whenever the number of full subscribing members (not including country members) amounts to sixty five, no candidate for admission as a subscribing member shall be proposed.

 

WITHDRAWAL OF VISITORS.

 

27. The W.M. may request visiting brethren to retire during the discussion of business relating to the private affairs of the Lodge.

 

DRESS OF MEMBERS.

 

28. Members shall, previous to entering the Lodge, be clothed according to Masonic rule.

 

 

 

 

MODE OF ALTERING BY-LAWS.

 

29. No new by-law, and no alteration of, or addition to existing by-laws, shall be made except at a regular meeting of the Lodge, or at a meeting specially called for the purpose and in pursuance of notice given, in writing, at the previous regular meeting, a copy of which notice shall be inserted in the summons calling such meeting and sent to every member ; and such new by-law, alteration or addition shall not be passed unless two-thirds or more of the members present agree to the same. (vide Book of Constitutions, Clause 8.30-3).

 

BY-LAWS TO BE PRINTED.

 

30. These By-Laws shall be printed in whatever format is deemed appropriate by a majority of members at a regular meeting of the Lodge. A copy is to be delivered to each member, and its acceptance in every case shall be deemed a declaration of submission thereto.
